These Terms of Service ("Terms") govern your access to and use of classes, services, and the website operated by The Spot Pilates LLC ("The Spot," "we," "us," or "our"), located at https://www.thespotpilates.com. By registering for, booking, or attending any class — whether in-person or virtual — you agree to be bound by these Terms. If you do not agree, please do not use our services.
1. Services Offered: The Spot Pilates LLC offers the following services:In-person Pilates classes at our studio location in Charlotte, North CarolinaLive virtual Pilates classes conducted via ZoomMembership packages including drop-in, 8-pack, and unlimited recurring plansFriends & Family discounted membership plansMerchandise and branded products (where available)Class schedules, pricing, and availability are subject to change at any time. We reserve the right to cancel or reschedule classes with reasonable notice.
2. Eligibility: Our services are open to individuals of all ages. Participants under the age of 18 must have written consent from a parent or legal guardian prior to participating in any class. By booking a class for a minor, the parent or guardian accepts full responsibility and agrees to these Terms on the minor's behalf.You represent that all information you provide during registration is accurate and complete. We reserve the right to refuse service to anyone at our discretion.
3. Bookings & Cancellations
3.1 How to Book: Classes may be booked through our website (https://www.thespotpilates.com) or our designated booking platform. All bookings are subject to availability.
3.2 Late Cancel & No-Show Policy: We enforce the following fees to respect our instructors' time and allow other members access to classes:Late Cancellation (cancellation within the designated window before class start): $5.00No-Show (failure to attend without cancellation): $8.00These fees will be charged to the payment method on file. By booking a class, you authorize The Spot Pilates LLC to charge applicable late cancel or no-show fees.
3.3 Class Packages & Memberships: All class packages and memberships are non-transferable. Recurring memberships will auto-renew until cancelled. You may cancel a recurring membership by contacting us at info@thespotpilates.com prior to your next billing cycle. Refunds are not issued for unused classes in a package unless required by applicable law.
4. Payments: All fees are charged in U.S. dollars. By providing a payment method, you authorize us to charge applicable fees including class packages, membership dues, and any late cancel or no-show fees. We use secure third-party payment processing and do not store full payment card details on our systems.Merchandise sales are subject to applicable North Carolina state and local sales tax (currently 7.25% in Mecklenburg County, subject to change).
5. Virtual Classes: Live virtual classes are conducted via Zoom. By participating in a virtual class, you acknowledge and agree that:You are responsible for ensuring a safe and adequate space in which to participateYou are responsible for your own equipment, internet connection, and technical setupVirtual classes are live and are not recorded or made available for replay unless explicitly stated otherwiseThe Spot Pilates LLC is not responsible for any technical difficulties that prevent your participationA Zoom link will be provided upon booking. Please join on time, as late entry may be disruptive to other participants.
6. Health, Safety & Assumption of Risk: Pilates involves physical activity. By participating in any class — in-person or virtual — you acknowledge that:Physical activity carries inherent risks of injuryYou are voluntarily participating and assume all risks associated with participationYou have consulted with a physician or healthcare provider if you have any health conditions, injuries, or concerns that may affect your ability to participate safelyYou will inform your instructor of any injuries, limitations, or health conditions prior to classA separate Liability Waiver is required prior to participation. Your completion of the waiver is a condition of enrollment. These Terms do not supersede or replace your signed waiver — both apply.
7. Code of Conduct: All participants — in-person and virtual — are expected to conduct themselves respectfully. We reserve the right to remove or ban any participant who:Engages in disruptive, threatening, or disrespectful behaviorViolates the privacy of other participants (including recording classes without consent)Misuses our booking system or attempts to circumvent our policiesNo refunds will be issued in the event of removal due to a conduct violation.
8. Intellectual Property: All content on our website and in our classes — including class formats, programming, branding, and materials — is the intellectual property of The Spot Pilates LLC. You may not reproduce, distribute, or create derivative works from our content without prior written permission.You may not record any class, in whole or in part, without explicit written consent from The Spot Pilates LLC.
9. Communications: By registering with The Spot Pilates LLC, you consent to receive booking confirmations, class reminders, and service-related communications via email or text message. You may opt out of marketing communications at any time by contacting us at info@thespotpilates.com. Transactional communications (such as booking confirmations and policy updates) cannot be opted out of while you remain an active member.
10. Limitation of Liability: To the fullest extent permitted by applicable law, The Spot Pilates LLC, its owners, instructors, and staff shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of our services. Our total liability to you for any claim shall not exceed the amount paid by you for the specific class or service giving rise to the claim.Nothing in these Terms limits liability for gross negligence, fraud, or any other liability that cannot be excluded under North Carolina law.
11. Modifications to Terms: We reserve the right to update or modify these Terms at any time. Changes will be posted to our website with an updated effective date. Continued use of our services following any change constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
12. Governing Law: These Terms are governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Mecklenburg County, North Carolina.
